On January 16, I spoke with Louis Boreham of the Truth Over Comfort podcast about Israel’s genocide in Gaza, South Africa’s genocide case against Israel at the International Court of Justice (ICJ), and the US government’s complicity in this crime against humanity. 


Louis questioned whether Israel’s military operation meets the definition of “genocide” under international law, and I explained why it does.

As an update to events since this interview was recorded, the ICJ on January 26 ordered Israel to carry out provisional measures to fulfill its obligations under the Genocide Convention. South Africa’s case is ongoing, but in the meantime, the court agreed, the civilian population must no longer be the target, and humanitarian aid must be allowed in. Israel must report to the ICJ about all measures taken to fulfill its obligations, but the Netanyahu government immediately announced that the ICJ will not stop Israel from continuing what it has been doing.


In essence, the ICJ determined that South Africa had made a plausible case that Israel has been committing genocide.


Specific topics Louis and I discussed include:

  • How more children were killed in just the first 3 weeks of Israel’s military assault on Gaza than in all of the world’s other conflict zones combined for each of the three preceding years.

  • Why the claim that Palestinian civilians only ever die because they are being used by Hamas as “human shields” is a demonstrable lie.
  • How the term “human shields” is used as a euphemism to mean any Palestinian civilians killed by virtue of their being in Gaza.
  • Why the claim that Israel ended its occupation of Gaza in 2005 is false, and how Israel has kept Gaza under an illegal siege since 2007.
  • Why Hamas’s rule in Gaza is a direct consequence of Israeli and US government policies.
  • Why Israel’s military operation violates the Genocide Convention and meets the definition of “genocide” in that treaty.
  • How counterfactual arguments that begin “if Israel was committing genocide, it would…” to deny genocide are a non sequitur fallacy that overlook how Israel is perpetrating this crime within the limits of what is politically feasible.
  • Why the only reason that Israel is able to perpetrate genocide is because of US government support for its crimes against the Palestinians.
  • Why we Americans have a moral obligation to ensure that the US government does not perpetrate crimes against humanity in our name.
  • How more Palestinians could die from malnutrition and disease than have been killed by Israel’s indiscriminate bombing.
  • What will happen to Gazans now that so many no longer have homes to return to?
  • Why I don’t think that once Israel’s military operation is over that the situation will go back to the status quo that existed before 10/7 because the thin veil has been lifted and the true face of modern political Zionism has been revealed.
  • How Israeli Prime Minister Benjamin Netanyahu has maintained a policy of utilizing Hamas as a strategic ally to block any movement toward peace negotiations with the Palestinians.
  • How Israel was established by ethnically cleansing Palestine and exists as a Jewish supremacist state founded on a manifest rejection of the fundamental human rights of the land’s indigenous inhabitants.
